Terms and Conditions
1. Scope and Provider
These General Terms and Conditions ("GTC") apply to all orders placed through this online shop.
2. Products
We offer handmade pottery and natural incense. Due to the nature of these products, variations in shape, size, color, and finish may occur and are not considered defects.
Since these are handmade and/or natural products, the actual colors of the items may vary slightly from the photos online.
3. Conclusion of Contract
The presentation of products in the online shop constitutes a non-binding invitation to order.
A binding contract is formed when you place an order and receive an order confirmation by email.
The contract is concluded with: Livia Gioia Mussato trading as Livia Gioia Ceramics, Hinterdorf 34, 5323 Rietheim, Switzerland.
By placing an order you warrant to us that
(a) you are legally capable of entering into binding contracts;
(b) you have full authority, power and capacity to agree to these terms and conditions;
(c) all the information that you provide to us in connection with your order is true, accurate, complete and non-misleading;
(d) you will be able to take delivery of the products in accordance with these terms and conditions.
We reserve the right to refuse or cancel orders at our discretion, particularly in cases of suspected misuse or legal restrictions.
4. Prices and Payment
All prices are stated in CHF (Swiss Francs) or EUR (Euro) according to the currency selection on the website.
Prices are excluding VAT as our small business is exempt from VAT under Article 10(2a) of the Swiss Value-Added Tax Act.
We reserve the right to change prices at any time. The prices published at the time the contract is concluded apply.

Payment is due immediately upon order.
5. Shipping and Delivery

6. Right of Withdrawal and Returns
We grant the right of withdrawal from the contract and a return period of 7 days from receipt of goods under the following conditions:
- Items must be unused and in their original condition.
- Items must be returned in their original packaging or equivalent / better.
- Customers are responsible for return shipping costs and bear the risk for any damage enroute.
- Items purchased on offer, custom ordered items made to an individual choice of the customer, goods that are clearly personalized and gift vouchers are excluded from the right of withdrawal.

7. Refunds
Refunds will be issued within 14 days after receipt and inspection of returned goods.
We may recover an amount up to the contract price in case the value of the returned products is diminished by any amount as a result of the handling of those products by the buyer or in case of damage during return shipment. We may recover that amount by deducting it from any refund. Delivery charges are excluded from any refund.
Refunds are made using the original payment method.
8. Warranty
Statutory warranty rights under Swiss law are restricted to a 14 day period upon receipt.

9. Liability
To the maximum extent permitted by applicable Swiss law, Livia Gioia Ceramics excludes all liability for any direct, indirect, or consequential damages arising out of, or in connection with, the use of our website, the products purchased, or the inability to use our services.
The limitations and exclusions of liability in these Terms and Conditions do not apply to damages caused by intent and gross negligence and any other liability that cannot be legally limited or excluded.
10. Product Use Disclaimer
All our products are intended for their specified, normal use only. Livia Gioia Ceramics shall not be held liable for any damages, injuries, or losses resulting from the misuse, abuse, or improper use of our products. The customer assumes all risks and responsibilities for any use outside of the product's intended purpose
11. Data Protection
Personal data is processed in accordance with our Privacy Policy.
12. Applicable Law
These GTC are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13. Dispute Resolution
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final Provisions
If any provision of these GTC is held invalid, the remaining provisions shall remain in full force and effect.
